Thus, when a customer orders a product displayed for sale on the website compagniedeprovence.com, it is deemed that he has read, understood and fully accepted these terms and conditions prior to his purchase.
Compagnie de Provence reserves the right to adapt or amend these terms and conditions at any time. In case of modification, the terms and conditions in force at the time order is placed will automatically apply.

PRESENTATION OF THE PRODUCTS
Compagnie de Provence’s offer is made of the products displayed for purchase on the website compagniedeprovence.com. Prior to ordering and in accordance with Article L.111-1 of the French Consumer Code, customer can find on the website the main characteristics of the products he wishes to order. Compagnie de Provence reserves the right to change its collection, product list and range at any time. The photographs of the products displayed on this website are not contractual.


PRICE OF THE PRODUCTS
Prices displayed on the website are quoted tax-inclusive in Euros (€) and exclusive of delivery charges. Shipping rates depend on the amount of the order, the weight, and the country of destination of the delivery.
Compagnie de Provence reserves the right to change prices at any time, but undertakes to apply the rates provided at the time the order is placed.
During sales and promotions, products can be identified thanks to a sign mentioning the appropriate indication next to the price.


AVAILABILITY OF PRODUCTS
Product offers and prices are valid as long as they are displayed on the website, while supplies last. Compagnie de Provence does its best to ensure customer the availability of its products.
If an item is out of stock, the amount will automatically be deducted from the order and customer will have to process a new order once the product is available.

STEPS TO ORDER
To order an item displayed on the website compagniedeprovence.com, customer must complete the following steps. After clicking on the icon “Add to basket” and after reviewing the details of his order (description, quantity, price, etc…), customer confirms his product selection by clicking on the “confirm” button. If customer has been awarded a discount coupon, he must previously enter the promotional code he received in the appropriate field. Upon his first order, customer must fill in a form with the following information: title, surname, first name, email, date of birth, complete delivery address, phone number. At this time, customer creates his password. Once the payment method is selected, customer firmly and irrevocably confirms his order.
Prior to any transaction, customers acknowledges having read the sales terms and conditions and expressly declares accepting them by checking the box “I have read the sales terms and conditions and fully agree to them.

► PAYMENT


PAYMENT BY CREDIT CARD
Compagnie de Provence accepts Carte Bleue, Visa and Mastercard. American Express cards are not accepted.
Customer provides his credit card number, its expiry date and the card security code. He finally confirms his order by clicking on the “Confirm” button.



SECURITY OF PAYMENT
Compagnie de Provence never has access to customer’s confidential banking information.
To secure payment, Compagnie de Provence has selected the BNP Paribas online payment module, which uses SSL encryption technology to ensure that the information relating to the transaction between customer’s computer and payment server is encrypted.
Once the payment is authorized, customer information is automatically deleted. This is why customer is requested to provide his banking information each time he places an order paid by credit card.


PAYMENT VIA PAYPAL
With PayPal, customer’s banking information is never disclosed to Compagnie de Provence. PayPal encrypts and protects customer’s credit card number once and for all. To pay online, customer is only required to provide his email address and his password.


CONTROL OF THE TRANSACTION
Once the payment is authorized by the bank, order becomes effective and an order confirmation is sent to customer by e-mail.
In the event the bank declines payment, Compagnie de Provence will automatically cancel the current order and will notify customer by email.
Compagnie de Provence reserves the right to cancel orders in case of any dispute regarding the payment of a previous order, suspected credit card fraud, or any other legal reason.
When an order exceeds a certain amount Compagnie de Provence may require customer to provide further information by email (copy of ID, proof of address, …). These documents are only requested to make sure that the customer is the person processing the order.

Goods are delivered to the address indicated by customer, or post office, or retail store chosen from the list provided upon finalizing order.
Compagnie de Provence cannot be held liable if the address indicated is incorrect of if customer fails to claim a parcel from carrier within the given deadline. Additional fees relating to the delivery of a new parcel will be borne by customer. 

 

DELIVERY TIME
Orders are processed within 24h during working days. Orders placed on Friday after 10am, Saturday, Sunday will be processed on next Monday. Orders are delivered in 1 to 5 working days depending on the selected carrier.

Compagnie de Provence makes every effort to meet delivery deadlines. However, delay in delivery shall not give rise to any compensation, reduction or order cancellation.

Yet, in the event of a failure to deliver an order within 30 days of its submission due to force majeure, customer may cancel his purchase. In such case, Compagnie de Provence will refund the sums already paid, excluding any indemnity or compensation claimed by customer.
Events considered as force majeure include cases of fire, total or partial strike, accident or failure on the part of carrier or any supplier of Compagnie de Provence.
In any case, timely delivery implies that customer is up to date with its obligations towards Compagnie de Provence. Compagnie de Provence cannot be held responsible for consequences due to a delay in delivery.


UPON DELIVERY
Upon receipt, customer must carefully check the goods delivered before signing the receipt of the carrier in charge of the delivery. He must write on the delivery slip all reservations concerning the consignment and sign it.
This inspection is deemed to have been made as soon as customer, or any person authorized by him, signs the receipt.
Upon delivery, if the original packaging is damaged, torn or opened, customer must check the condition of the goods. If they have been damaged, customer must refuse the parcel and indicate his reservations on the delivery slip (parcel refused because opened or damaged).

 

► RETURN AND EXCHANGE POLICY

By application of the law of January 6th 1988, customer has a right of withdrawal that is valid for a period of 14 calendar days from the date of receipt of his order. Within this time frame, he may return any article which does not suit him. In such case, the item should be returned in its original packaging and in perfect condition, for an exchange or a refund. If customer uses his right of withdrawal, Compagnie de Provence will fully refund him within 14 days, without penalty except for the return shipping costs (Article L121-20 of the French Consumer Code).
IMPORTANT NOTE: withdrawal will not be accepted if the article returned is not in perfect condition for resale. Otherwise, the item will be sent back to customer at his own expense.
After this withdrawal period, all returns, occurring either under amicable settlement of a claim or for any other matter, will be subject to a formal agreement between the customer and Compagnie de Provence. A credit will be issued to customer. Upon receipt of the agreement, customer must return the article to Compagnie de Provence within 14 days. After that, the return will be refused. Returns should be made via colissimo suivi (tracked parcel). It is important to add that Compagnie de Provence does not endorse responsibility for parcels they do not dispatch. Only the sender of the parcel has the authority to request postal services to investigate.
Shipping expenses will be borne by customer.
Articles must be returned in their original packaging and unused, with a copy of the invoice to:

TERMS OF IMPLEMENTATION OF STATUTORY WARRANTIES



When acting legal guarantee of conformity, the Purchaser:
- Granted a period of two years from delivery of the product to act;
- Can choose between repair or replacement of the goods subject to the conditions of costs provided for in Article L211-9 of the Consumer Code;
- Is offered to prove the existence of the lack of conformity of the good during the six months following delivery of the goods.

The legal guarantee of conformity is applicable irrespective of the commercial guarantee eventually granted.
